Lere By-Election: Court Vacates Restraining Order on PDP Candidate

Justice Ambo Yakubu John of the High Court of Justice Saminaka Division, Thursday, has set aside the Court Order restraining People Democratic Party, PDP, from submitting the name of its candidate, Barr. Ibrahim Usman (6th Respondent) who emerged victorious at its party’s primary election for the coming by-election for Lere Federal Constituency of Kaduna State to be conducted on 16th August, 2021.

In retrospect, Hon. Justice Ambo had previously ordered that: “An order of Interim Mandatory Injunction is hereby made restraining the respondents, their agents, servants, privies, employees and representatives from further violating and contravening the applicant’s fundamental right to freedom from discrimination and the Applicant’s Fundamental right to peaceful assembly and association and to belong to any political party, trade union or any other association for the protection of the Applicant’s interest in the PDP by restraining the discriminatory presentation of the 6th Respondent to the 7th Respondent (INEC) as candidate in the Lere Federal Constituency of Kaduna State by-election of 14th day of August, 2021, pending the hearing and determination of the substantive application for enforcement of fundamental rights of the Applicant.”

The seat of Lere Federal Constituency was declared vacant by the Speaker of the House of Representatives, Femi Gbajabiamila, after the death of the lawmaker representing the constituency, Suleiman Lere on April.

However, hearing of the substantive case has been adjourned to 18th of August, 2021.
