Jubilation, As Court Vacates Exparte Order, Clears Ground for The Swearing-in Of PDP Candidate As Member, Kaduna State House Of Assembly

The Judge of the Kaduna State High Court of justice No. 1 sitting in  Zaria, M. k Dabo has vacated the initial exparte order he issued on the 1st day of July, 2021 restraining the swearing of Ubale Alibaba of the Peoples Democratic Party after he was declared winner of the Sabon Gari re-run election by INEC on 19th June, 2021.
Previously, the trial Judge had granted an interim order exparte pursuant to which he restrained the Speaker of the KDHA from swearing-in Ubale Alibaba who is the elected member of the Sabon Gari Constituency into the Kaduna State House Of Assembly.
The Judge in his own wisdom asked the parties to address him on whether he has the jurisdiction in the first instance to issue such an order. In compliance, parties addressed the Court on the propriety or otherwise of the order exparte made on the 1st day of July, 2021

The judge adjourned the substantive suit to the 4th of August, 2021 for the hearing of the objection.
